Laws Regarding the Use of Cell Phones When Driving in California
The state of California is serious about preventing motorists from using cell phones when driving. Three separate laws govern the use of cell phones when driving. The first law bans individuals from speaking on a cell phone without a hands free device while driving. The second law prevents drivers under the age of 18 from using a cell phone under any circumstances, and the third law bans California drivers from texting when driving.
California drivers must use a hands free device while they are driving. These devices can include a Bluetooth device or a similar device that allows the speaker to make and receive calls using an earpiece that covers one ear. Alternatively, drivers can use their speakerphone feature on their cell phones, however, they are cautioned to use care when placing and receiving calls. Contact the California DMV for a complete list of approved hands free devices.
Some exceptions to this particular law exist. Police officers and drivers of emergency vehicles can use their cell phones without a hands free device provided that they are on duty and are using their cell phone to perform their job at the time. Individuals are also free to use their cell phones without a hands free device if they are driving on private property. Yet, drivers under the age of 18 cannot use a cell phone when driving except if they are calling emergency personnel, even if they are using a hands free device.
Motorists in the state of California are also forbidden from using their cell phones to send text messages while driving. This law also covers composing, sending or receiving e-mail and instant messages. There are no exceptions to this law as a result of the dangers of texting when driving.
The fines for improper cell phone use of for texting while driving are rather low. For example, a cell phone violation will only cost the driver $20 for the first violation. However, the fines become increasingly steeper with each subsequent violation, so drivers should take care to use their cell phones properly while driving in California.
