What Happens if I Have an FTA Warrant in My Name?
When you get a traffic citation in California, you are asked to sign the ticket. Your signature affirms that you understand that you should either pay the ticket or make arrangements to appear in court by the date listed on the ticket. In addition, follow up information about your fine or court appearance will come in the mail shortly after your citation. Do not ignore this information. If you do not do not appear in court or pay your fine, the judge will issue a bench warrant for your arrest. This warrant is referred to as a "failure to appear" warrant.
The penalties for a failure to appear warrant are very steep in California. Not only should you pay your original ticket and other penalties, but you will also receive the points on your driver's license from that infraction. In addition, you will receive further fines and penalties for the FTA warrant. Points from an FTA warrant stay on your record for 5 years, or 10 years if the FTA resulted from a DUI charge. Aside from the fines and points, an FTA warrant is a misdemeanor in California. This crime will appear on a background check indefinitely, and you may be denied employment, denied housing, denied public assistance benefits, or even be fired for the offense.
When you are are issued a failure to appear warrant, you should act on it. Do not just let it go, because sooner or later you will be pulled over by a police officer or an officer will need to come to your house. When the officer checks for warrants, they will discover your failure to appear warrant and arrest you on the spot.
The first thing you should do when you find out that a failure to appear warrant has been issued in your name is to contact an experienced traffic ticket attorney. Your lawyer can appear in court on your behalf and plead your case. In some cases, a judge will be more lenient when you have a knowledgeable lawyer advocating for you. Your fines and penalties may be lowered, or the judge may even dismiss the warrant entirely and request that you merely pay your original ticket.
Do not risk arrest or having a criminal charge on your record. The fines and penalties from the FTA warrant are simply too steep to accept without seeking legal advice first. You owe it to yourself to obtain a skilled traffic ticket lawyer.
